This policy (together with our End User License Agreement), sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it. By visiting our site/app, you accept and consent to the practices described in this policy.

1. Information we obtain and use

We obtain information about you from various sources, such as: applications, identification documents, personal financial statements, etc. and other written or electronic communication reflecting information such as your name, address, passport details, identification numbers, biometric information, telephone number, occupation, assets, income and any other information we deem necessary.

We sometimes collect certain information during your visits to perform certain tasks such as conduct research on your behavior on our site/app in order to improve our services. We will not disclose your information to any person outside our organization except as described in this Data Policy.

2. Information obtained through Cookies and similar technologies

We use cookies to personalize our Services for you and to collect aggregate information about usage of our Services. 3. be adequate, relevant and limited to what is necessary to fulfil the purpose of processing.

4. be accurate and where necessary, up to date. In the event data is inaccurate, steps should be taken to rectify or erase such data.

5. not be kept for longer than necessary for the purpose of processing.

6. be processed in accordance with the data subject’s rights

Any personal information provided from you to Budchat will be used with your consent, or under the following underlisted instances:

1. Cases where processing of personal data is required for the fulfilment of a contractual obligation.

2. Cases where processing of personal data is required for compliance with legal and/or regulatory requirements.

3. Cases where processing is required to protect your vital interest or that of any other natural person.

4. Cases where processing is required for an activity to be carried in significant public interest.

5. Cases where processing is required for legitimate interests of Budchat or a third party insofar as this does not conflict with the requirements for the protection of your personal data.

Your personal information is used in:

1. Updating and enhancing Budchat’s records

2. Executing your instructions.

3. Establishing your identity and assessing applications for our products and services

4. Pricing and designing our products and services

5. Administering our products and services

6. Managing our relationship with you

7. Contacting you, for example in instances where we suspect fraud on your account

8. Conducting and improving our businesses and improving your experience with us

9. Complying with our legal obligations and assisting government and law enforcement agencies or regulators/supervisors

10. Identifying and informing you about other products or services that we think may be of interest to you.

We may also collect, use and exchange your information in other ways permitted by law.

4. How We Share Information

We may share your Personal Information with unaffiliated third parties:

(4) if the information is provided to our third-party service providers to perform functions on our behalf (e.g., analyzing data, providing marketing assistance, providing customer service, processing orders, etc.);

When you are no longer our customer, we continue to share your information as described in this Data Policy.

We disclose information with BUGLY for our commercial purposes. However, we;

• require them to agree to use your data in accordance with the terms of this Privacy and Cookie Notice, our Privacy Policy and in accordance with the law; and

• only permit them to process your personal data for specified purposes and in accordance with our instructions. We do not allow our third-party service providers to use your personal data for purposes other than those contained in this Policy not for their personal use.

5. How We Protect Your Information

We take appropriate technical and organizational measures to prevent loss, unauthorized access, misuse, modification or disclosure of information under our control. This may include the use of encryption, access controls and other forms of security to ensure that your data is protected. We require all parties including our staff and third-parties processing data on our behalf to comply with relevant policies and guidelines to ensure confidentiality and that information is protected in use, when stored and during transmission. Our security controls and processes are also regularly updated to meet and exceed industry standards.

Where we have provided you (or where you have chosen) a password feature which grants you exclusive access to your account, you are responsible for keeping this password confidential. We request that you do not to share your password or other authentication details with anyone.

6. Information You Provide

• Your Account Information. You may provide your mobile phone number and basic information (including a profile name of your choice) to create an Budchat Account. If you don’t provide us with this information, you may not be able to create an account to use our Services. You can add other information to your account, such as a profile picture and "about" information.

• Your Messages. We do not retain your messages in the ordinary course of providing our Services to you. Instead, your messages are stored on your device and not typically stored on our servers. Once your messages are delivered, they are deleted from our servers. The following scenarios describe circumstances where we may store your messages in the course of delivering them:

  • Undelivered Messages. If a message cannot be delivered immediately (for example, if the recipient is offline), we keep it in encrypted form on our servers for up to 7 days as we try to deliver it. If a message is still undelivered after 7 days, we delete it.

  • Media Forwarding. When a user forwards media within a message, we store that media temporarily in encrypted form on our servers to aid in more efficient delivery of additional forwards.

We offer end-to-end encryption for our Services. End-to-end encryption means that your messages are encrypted to protect against us and third parties from reading them. 

7. Opt-Out Rights

If you do not wish to receive offers or other notices from us in the future, you can "opt out" by following the "unsubscribe" instructions in any communication you receive from us.

8. Accessing Your Information

You must notify us of any change in your Personal Information by updating your profile through our Services. Any changes will affect only future uses of your Personal Information.

Subject to applicable law, which might, from time to time, oblige us to store your Personal Information for a certain period of time, we will respect your wishes to correct inaccurate information. Otherwise, we will hold your Personal Information for as long as we believe it will help us achieve our objectives as detailed in this Data Policy.

9. Information You Share Socially

Our Services may allow you to connect and share your actions, comments, content, and information publicly or with friends. We are not responsible for maintaining the confidentiality of any information you share publicly or with friends.

Our Services may also allow you to connect with us on, share on, and use third-party websites, applications, and services. Please be mindful of your personal Data needs and the Data needs of others, as you choose whom to connect with and what to share and make public. We cannot control the Data or security of information you choose to make public or share with others. We also do not control the Data practices of third parties. Please contact those sites and services directly if you want to learn about their Data practices.

10. Protecting Children's Data

Our Services are not directed, or intended to be attractive, to children under the age of 18. We do not knowingly collect Personal Information from children under the age of 18. If you are under the age of 18, do not use our Services or submit any information to us.

11. Changes to our Privacy Policy

Subject to applicable law, we may revise this Privacy Policy at any time and in our sole discretion. When we revise this Privacy Policy, we will post the revised version via our Services. The revised Privacy Policy will be effective upon posting via our Services, unless otherwise set forth therein or as otherwise required by applicable law. You are free to decide whether or not to accept a revised version of this Privacy Policy, but accepting this Privacy Policy, as revised, is required for you to continue accessing or using our Services. If you do not agree to the terms of this Privicay Policy or any revised version of this Privacy Policy, your sole recourse is to terminate your access and use of our Services.
